Garza County Drug Possession Results in Case Dismissed
On October 7th, the entire firm worked as a team to win a dismissal in Garza County District Court. Our client was accused of 2nd degree possession of mushrooms and 2nd degree possession of THC. The penalty for a 2nd degree felony in Texas is governed by the Texas Penal Code § 12.33: imprisonment 2 to 20 years plus a possible fine of up to $10,000. For drug possession of THC and mushrooms, the amount found in possession and it’s type and form (raw mushrooms, synthesized, THC concentrate, etc can all result in higher fines and jail time.
Attorneys, Travis Wiebold, Chuck Lanehart and Fred Stangl prepared a brief in support of our motion to suppress. It was finalized by our uber-legal assistant Bernadette Vaughn who put the brief together in proper legal format.
Defending Our Client Against Serious Drug Possession Charges
The legal issues involved whether the officer had reasonable suspicion to detain the client for driving outside a traffic lane and whether the officer had probable cause to search the vehicle.
Aside from the usual arguments on the facts and the law, we attached a rev.com transcript of the entire conversation among the client, his passenger, the officer and his supervisor. (The drug dog’s comments could not be translated.) Law clerk Eddi Clements assisted with the transcription. We also attached a Google map of the area in question.
The District Attorney studied the facts and the law and agreed to dismiss the case without a hearing.
