May 28th DWI Case

Chuck Lanehart obtained a pretrial diversion for his client, a 20-year-old college student accused of Driving While Intoxicated. He faced up to a year in jail and fines up to $4,000, plus a one-year driver’s license suspension. Chuck provided the prosecutor with compelling evidence of the client’s good character and problems associated with the police investigation and arrest. The client will be eligible to have his arrest expunged upon completion of an 18-month informal probation.

May 29th DWI and Drug Case

On May 29, Chuck Lanehart obtained a pretrial diversion for his client, a 20-year-old college student accused of Driving While Intoxicated and Possession of Marijuana. He faced up to a year in jail and fines up to $4,000, plus a one-year driver’s license suspension.

The student had been arrested while parked in a fast-food parking lot, and Chuck raised a legal question as to whether the client was “operating a motor vehicle,” which is required for a DWI conviction. Chuck also provided evidence of his client’s good character and the prosecutor agreed to a 12-month pretrial diversion. Upon completion of the program, the client will be eligible to have his arrest expunged.
